False claim of property, plaintiff ordered Tk 15,000 as compensation by court at Sunamganj

Court has ordered a compensation of 15,000 taka for the case filed by the plaintiff for claiming the government property as illegitimate property and wasting the time of the court. The order was given by Assistant Judge Asif Alam Chowdhury of Doara Bazar Court.

 

It is known from the court sources that in the case of more than a thousand acres of 58 Mauzas across three upazilas of Sunamganj District, Tahirpur, Jamalganj, Bishwambhar Pur, in 1973, the plaintiff Kali Tanay Chowdhury and Gong Sri Madan Mohan Jiu Debottar filed a suit in the relevant Sylhet court to declare ownership as an asset of the estate and filed a case. The Suit property is an economically and environmentally very important government property due to its geographical proximity to Tanguar Haor, Jadukata River, Boulai River.

 

The plaintiff claimed this huge state property as the assets of the estate of Sri Sri Madan Mohan Jiu Debottar and filed this case in 1973 in the then Sylhet Court for declaration of ownership as servitude.

 

 In course of time, this case was transferred to Doara Bazar Assistant Judge Court. The Doara Bazar Assistant Judge Court was directed to settle the case within 6 months from the receipt of the order and Civil Revision No. 1688/2021 arising from the 63/18th case.

 

According to that instruction, Doara Bazar Assistant Judge Court disposed of the case on 12/11/2023 before the completion of 6 months. Along with that, in the judgment given, the plaintiff's case was dismissed and a landmark order was issued. The plaintiff was ordered to pay a compensatory cost of TK 15,000 to the treasury of the defendant, after a lengthy hearing in view of the defendant's claim that the court and the respondent government were wasting valuable time by prolonging the case with false information.

 

In this regard, the government's AGP Adv. Moni Shankar Pal said that the plaintiff caused a huge loss to the government by presenting false information to the court. The order passed by the Honorable Doara Bazar Court judge will be a landmark judgment. The plaintiff has wrongfully caused a huge loss to the government. Later, a decision will be taken subject to discussion with the concerned officials including the District Commissioner regarding the said order.
